Terms of service
These terms are an agreement between your business and the company that runs APTRYK ("APTRYK", "we"). They cover your use of the APTRYK portal: the staff app, the customer portal you offer your own customers, and the services around them. By creating an account or using APTRYK you accept them for your business.
1. Who may use APTRYK
APTRYK is for businesses. The person who signs up must be allowed to bind the business to these terms. Everyone else joins only from an invitation sent by an administrator of a business already on APTRYK.
Your administrators decide who in your business has access and what each person may do. You are responsible for the people you invite, staff and customers alike, and for keeping their sign-in details private.
2. Subscriptions, trials and payment
- APTRYK is a monthly subscription. The plans and what each includes are on the pricing page.
- Payment is taken by Stripe. A card is required to start, also for a free trial. Stripe shows the exact amount before you pay.
- Changing plans is prorated by Stripe. A plan with fewer staff seats than you are using cannot be chosen until you free seats.
- How sales tax is charged will be stated here before launch.
- Prices may change. We will tell your administrators before a change applies to your subscription.
3. Canceling, failed payments and the end of the service
- You can cancel at any time from Admin, Billing. Canceling takes effect at the end of the period you paid for, and everything works until then.
- After the subscription ends, the portal stays open read only for 30 days so you can look things up and download your data.
- If a payment fails, you keep full access for 7 days. After that the portal is read only until the card is updated.
- The refund policy will be stated here before launch.
4. Your data
The records and files your business puts into APTRYK are yours. We use them only to run the service for you, as described in the privacy policy, and we keep each business's records apart from every other business's.
An administrator can download all of your data at any time from Admin, Billing (one file per kind of record, as CSV and JSON). After your subscription ends we delete your business's records, files, stored keys and logins 30 days later, or sooner if you ask in writing. Our own billing records about your subscription are kept as tax records.
You are responsible for having the right to put the data you add into APTRYK, including your customers' and suppliers' details, and for the connections you set up to other services (for example your own Stripe, Zoho or Google accounts).
5. Acceptable use
You agree to follow the acceptable use policy. We may suspend an account that breaks it, puts other businesses at risk, or is used for something unlawful. We will tell your administrators why, unless the law or the safety of others prevents it.
6. Support and changes to the service
Questions and problems go to the support address (to be added before launch). We improve APTRYK continually and may change or remove features. We will tell your administrators ahead of a change that takes away something your plan includes.
We work to keep APTRYK available and your data safe (see security), but we do not promise that it will be uninterrupted or free of errors, and these terms do not include a service level or uptime commitment.
7. Other services
APTRYK relies on other companies to run (listed on the subprocessors page) and can connect to services you choose. Your use of a service you connect is also governed by that service's own terms.
8. Liability, warranties and disputes
For counsel to complete: disclaimer of warranties, limitation of liability, indemnities, governing law and venue, and how disputes are resolved. These clauses are intentionally left out of this draft.
9. Changes to these terms
We may update these terms. The date at the top shows the latest version. For a change that matters, we will tell your administrators before it takes effect; continuing to use APTRYK after that means you accept it.
